What a UAE tax agent can and cannot do under the Tax Procedures Law, who can register with the FTA, and when appointing one is worth it.
What a tax agent is, in plain terms
An FTA-registered tax agent is a person listed on the Federal Tax Authority's register whom you appoint to deal with the FTA for you: filing returns, answering queries, handling audits and challenging decisions. Using one is optional, and it does not move responsibility for your tax away from your business. It is worth it when you have no finance lead in the UAE, a complex corporate tax position, or a dispute with the FTA.
The legal definition sits in Article 1 of Federal Decree-Law 28 of 2022 on Tax Procedures, as amended (the consolidated text is on tax.gov.ae). In plain words, a tax agent is a person registered with the FTA and appointed to represent someone else before the Authority. The agent also helps that person meet their tax obligations and exercise their tax rights.
The title is protected. Article 12 says no one may practise as a tax agent unless they:
meet the conditions
are listed on the FTA register
hold a licence from the local licensing authority
Anyone offering "tax agent services" without all three is not a tax agent in the legal sense, however polished their website looks.
What a tax agent can do for you
So what does a tax agent do day to day? The role is broader than pressing "submit" on a return. A registered agent can:
Act in your name with the FTA on your tax affairs (Art. 14 of the Tax Procedures Law)
Prepare and submit VAT and corporate tax filings on EmaraTax. Our EmaraTax guide covers the portal itself.
Handle FTA correspondence and queries, including requests for supporting documents
Support you through an FTA tax audit, from the first notification to the final assessment
Prepare reconsideration requests when you disagree with an FTA decision. You have 40 business days from notification of the decision (Art. 29).
Keep your tax records and hand them to the FTA when asked (Art. 15). This duty covers clients they represent now and clients they represented in the past.
Keep your information confidential
Exactly what your agent does depends on the agreement you sign. Article 14 of Cabinet Decision 74 of 2023, the Executive Regulation, requires the agent to act in line with that agreement. If audit support is not in the engagement letter, do not assume it is included. When an appointment ends, tell the FTA. Under Article 14(2) of the law, the Authority then stops dealing with that agent.
What stays with you, and where the agent's liability starts
This is the point to be clear on. Hiring an agent shares the workload. It does not hand over the risk.
You stay responsible. Article 14(1) lets you appoint an agent "without prejudice" to your own responsibility for your tax. Penalties for late returns and late payment still land on the business, not the agent. Corporate tax returns are due within 9 months of the end of the tax period, and our piece on UAE corporate tax deadlines and late penalties sets out what a missed date costs. If you are already penalised, read up on claiming a corporate tax penalty waiver.
The agent can rely on what you give them. Under CD 74 Article 14(2), an agent may rely on your information unless they have grounds to think it is wrong. Messy books therefore produce wrong returns, and the error is yours. Inconsistencies between your VAT and corporate tax figures can also prompt questions from the FTA.
Where the agent shares liability. Anyone who takes part in a tax evasion crime is jointly and severally liable with the person they helped, for both the tax and the administrative penalties (Art. 25(9)). The FTA must also delist an agent who commits a serious breach or takes part in evasion (CD 74 Art. 13(13)).
Agents must also refuse work that would break the law. A good agent will tell you no, and you should be glad they do.
Who can register as a tax agent with the FTA
Cabinet Decision 74 of 2023 sets the conditions. An individual applicant needs:
Good conduct and no conviction for a crime of dishonesty
Qualifications and experience, in one of three forms:
a degree in tax, accounting or law, plus 3 years' relevant experience in the last 5
another degree with a recognised professional qualification, plus 3 years in the last 5
another degree, plus 5 years in the last 8
FTA training and the FTA exam
The ability to work in Arabic or English
Professional indemnity insurance
A licence, or employment with a licensed entity
Firms, or juridical-person agents, register under CD 74 Article 12(2). They must be licensed as an audit, tax or law firm, hold professional indemnity insurance, and have at least one director or partner who meets the individual conditions and supervises the work.
Applications are made on EmaraTax. According to tax.gov.ae (checked 21 October 2026), registration costs AED 3,000 for an individual and AED 10,000 for a juridical person. An individual is listed for 3 years and a firm for 1 year (CD 74 Art. 13(8)). Before practising, an individual agent must be linked to a tax agency or juridical-person agent, and can be linked to only one at a time. The register and the FTA's guidance on becoming a tax agent are both on tax.gov.ae under Tax Support, then Tax Agents.
Do you need a tax agent? When it is worth it
No. Appointing one is optional. In the FTA's own words, taxable persons can file corporate tax returns and pay through EmaraTax themselves, or seek help from registered tax agents listed on tax.gov.ae.
Optional does not mean pointless, though. A tax agent in the UAE earns their fee in these situations:
You have no finance lead in the UAE, or the owner lives abroad
It is your first corporate tax return, or something has changed, such as moving from Small Business Relief to a full return
You run a free zone company claiming the 0% rate. See how free zone companies keep the 0% rate.
You run a group with several entities or related-party transactions. Our guide to transfer pricing for SMEs explains the paperwork involved.
You face an FTA audit, query or penalty that you want to challenge
You are making a voluntary disclosure
You are deregistering
The alternative is simple: an accountant prepares the figures and you file on EmaraTax yourself. That is cheaper and works for a clean, single-entity business. The trade-off is that nobody is authorised to speak to the FTA for you, so every query, document request and deadline lands in your inbox. Cosmos keeps the books and files UAE corporate tax and VAT returns through an FTA-registered tax agent, and also offers payroll and fractional CFO support.
Tax agent, tax consultant and accountant compared
The tax agent vs tax consultant question causes the most confusion, because the titles sound interchangeable. They are not.
Role | FTA listing needed | Can represent you before the FTA | Typical work |
|---|---|---|---|
FTA-registered tax agent | Yes | Yes | Filings, FTA correspondence, audits, reconsideration requests |
Tax consultant | No | No, unless also listed as an agent | Advice and planning. This is a commercial title, not a term defined in the Tax Procedures Law. |
Accountant or bookkeeper | No | No | Books, accounts and the figures behind returns |
Before you sign with any registered tax agent in Dubai or elsewhere, check them on the register:
Go to tax.gov.ae, then Tax Support, then Tax Agents, then Registered Tax Agents.
Search for the agent's name.
Confirm the listing shows the name, TAAN, firm, emirate and experience, and that the firm matches the one named in your engagement letter.
If you want one team to handle it all, Cosmos keeps the books and files UAE corporate tax and VAT returns through an FTA-registered tax agent, with payroll and fractional CFO support alongside. Book a call with Cosmos to see what fits your business.
FAQ
Is it mandatory to appoint a tax agent in the UAE? No. The FTA confirms that businesses can file and pay on EmaraTax themselves or use a registered agent. The choice is yours.
Can a tax agent file my corporate tax return? Yes. A corporate tax agent in the UAE can prepare and submit your return on EmaraTax and deal with any follow-up from the FTA. The return is still due within 9 months of your tax period end.
Who pays the penalty if my tax agent files late? Your business does. Appointing an agent does not shift responsibility for your tax, so any recourse against the agent depends on your agreement with them.
What is the difference between a tax agent and a tax agency? A tax agent is a person, individual or firm, listed on the FTA register. A tax agency is a firm registered with the FTA as a tax agency, and it needs at least one tax agent linked to it before it can practise. An individual agent can be linked to only one tax agency at a time.
How do I check a tax agent's registration? Search the Registered Tax Agents list on tax.gov.ae under Tax Support. If you cannot find them, ask for their TAAN and evidence of current listing, and check with the FTA: the list page carries a "last updated" date of 25 July 2023.
Can a non-resident owner use a UAE tax agent? Yes, and this is one of the strongest cases for appointing one. The agent deals with the FTA locally while you stay responsible for the business's tax.
